Is there a data base where u can find out how many car accident law suits have been filed by an individual?
Or any other data base where companies provide info about someone who filed any other like against stores restaurants or any other

Only if you fit in certain limited groups with a need to know. There is no specific data base that give identifying information available to the general public. Statistical, yes, specific, John Doe has filed law suits against these entities this many times, no.

Like any other suit. You hire a scum-bag lawyer, he/she/it drags it out for three years. He/she/it refuses to return your calls or see you, postpones court at least six times and settles hours before the court date for the original offer. Then YOU pay the lawyer 33% of your settlement money (if ANY).

The amount of time you have depends on which state you live in, the type of suit and whether or not it is in Federal or State court. This is because it all depends on the statute of limitations, which varies greatly in some cases.
Generally in an injury case you have two years, but check to see how long you truly have in your specific situation. Since it sounds as if you do not have a personnel attorney, you can check by calling one of these lawyers who advertise on TV. Just tell them you want to sue for an accident, x number of months/years ago, and is it possible. They will tell you how long you have and then they will try to get your business. Just use them to get the answer to your question, don't do anything else with them. If you go forward with a suit, find an attorney by referral, no real attorneys go on TV to get clients.

Is it true that in the state of MS you have to have complete control over your car at ALL times? so that would mean if you were to rear end someone it would automatically be there fault?

If you rear end somebody, it is you who has no control over the car, not the person you hit. It cannot be the fault of the person you hit unless he/she popped it into reverse and floored it, backing into you so fast you had no chance to avoid the collision. That would also take witnesses, or video to prove.

What is the average time to receive a settlement from a law suite for a car accident?
I was in a car accident a few weeks ago and I had to get an attorney. I am seeing a chiropractor for the back and neck pain. I was just wondering about the process and what are the average funds recovered. I had never been in a accident before so this is all really new to me.

Wow. Such interesting answers!
What I can tell you:
#1 How long it takes to settle depends on how long you treat. If you treat for 8 months? It will probably be a month or two after that before you can settle.
Why?
You got an attorney.
For all that hype - bodily injury attorneys don't do a whole lot of ANYTHING until it is time to put the demand package together. When you are DONE treating - they will order the medical records and bills. HOPEFULLY? They do this right. If they don't? Guess what? It takes longer.
The insurance company can not evaluate your claim without reviewing the records. If you're lucky - your attorney won't screw up and send non-related stuff. I can tell you from personal experience handling claims that attorneys who run injury mills (lots of claims) dont pay attention to squat. They will get in allllll your medical records and won't look at them before they send them off to the adjuster. If you're claiming a back injury from the accident and the adjuster gets medical records that claim you had a pre-existing back issue...guess what? That attorney just screwed you.
If you HADN'T gotten an attorney - you would complete a medical authorization (which you would do for the attorney anyway) so the insurance company could order the meds. (And in turn - since they would have all your records in hand - you would be able to get a quicker settlement.)
Now - pay attention......Your meds ARE going to get ordered no matter what. If the attorney orders them for you? That's another expense that is going to come out of YOUR settlement. If the insurance company orders them - that's their cost of doing busines. Did you really want to give the attorney allllll of your money? Probably not.
Anyway - you're going to have to stay on top of your attorney -not the adjuster - to get anything done. I've always been told that the squeaky wheel gets the oil. If you're a pain in the @$$ pestering your attorney? Chances are he will get up off of his...and get things moving for you. lol.
#2: after all meds are received - the adjuster will evaluate and make an offer to your attorney.
This is the part I love. The attorney? CAN NOT negotiate for you at that time (they might TRY to - but I ALWAYS told attorneys to take the offer to their client). They HAVE to advise you of the offer and make recommendations to you. They can advise you to push for more or what they recommend you ask for - they can work with you to establish a settlement strategy but...they can not do so without advising you.
Now - that back and forth negotiating? Can take a while. Missed phone calls, incomplete messages, people out of the office. You get the picture.
If you're treating with a Chiro that means you have soft tissue injuries. Not so complex - not a lot of treatment (There are guidelines for treating those injuries. If the treatment is excessive? The insurance company won't be responsible for those bills.) So, you didn't win the lottery (which is a good thing if you ask me - means you weren't seriously hurt & I'd rather have my health anyday) If you're looking for Christmas money? Get the ball rolling before December. Provided you're all better, that is.
