How do you get information that is incorrect on your criminal record removed?

My boyfriend and I were trying to get an apartment but we were declined becuase they stated his criminal records show he commited a misdemeanor (assult). He has not ever been arrest or had any criminal problems and had never even lived in the city were the crime was commited. There is a great chance his brother did it since he has had problems in the past but he said he did not. How do we go about getting this information removed from his criminal record becuase we were unable to get an apartment since his criminal record says he commited assult. He will also be looking for a new job soon and we want to make sure this will not be an ongoing problem

Make sure it is actually on his record. Get a true certified copy of his record from your local law enforcement agency. Your boyfriend may have to be fingerprinted and have to shell out a few dollars. Chances are the records the apartment complex checked was an online source and they aren't always accurate. Add to the fact that online records checks are also only as accurate as the person inputting the search criteria. So there's a chance that the information isn't actually on your boyfriends record.

If the information is on his record and it's incorrect he has to dispute that with the inputting agency, normally the arresting agency.

And there's always the chance that your boyfriend isn't being completely honest with you.

Even if you get your criminal record expunged, your fingerprints remain on file forever.

Can a felony criminal record be removed in Colorado?

My attorney colleague and I have a dispute over whether or not a felony conviction can be removed in the state of Colorado.

Can a felony conviction be removed from a person's record in the state of Colorado? If so, what is your source or or your sources? Thank you.

Colorado's forms of record clearing for felony and misdemeanor convictions are very restrictive to nonexistent.

In Colorado, a person may petition to have his arrest and criminal records sealed if the person was not charged with a crime, if the case was completely dismissed, or if the person was acquitted; unless the offense was not charged, or the case was dismissed, due to a plea agreement in a separate case.

A person with a felony conviction can apply for a pardon, but it's not likely.

How can someone go about getting a non-violent felony conviction removed from their criminal record?

I violated an Order for Protection 8 years ago from my ex-wife. It is STILL causing problems for me when I apply for jobs. This is ridiculous. Now that I have graduated from college it's time for me to get on with my life, but I can't do anything until this is resolved.

Hello Michael. I will add just a little bit more to the two illustrious posters above me.

Certain first time felonies can be expunged. This is highly state specific with time elements that apply. Most states demand that you are free and clear of legal encumbrances for at least 5 years ( some have 7 years). If you have more than one number, you cannot get an expungement.

Trooper is absolutely correct that you can research this yourself through the Clerk of Courts. Another way, but more costly, is to use an attorney within the jurisdiction of the arrest/conviction. He can tell you if you are elligible for an expungement and can draw up the petition and submit it to the court in your behalf.

As I am sure you are aware, once you have an expungement, your rights will be restored.

How long dose drink driving conviction take to be removed from your criminal record?

A friend of mine was done for drinking driving under the influence and this was two years ago. He was baned for 12 months and served his time so now he is woudering how long it take to be removed from his criminal record

It does not go away-- ever. Any time his criminal background is run, it will be there. Don't know where you guys got the idea it was going away.

The insurance rate may go down after a few years as long as he doesn't get into any more trouble while driving.

Is there a way to have a felony removed from a criminal record?

In the year 2000 i was convicted of a non-violent felony in Pennsylvania. It was the one and only time I have ever been in trouble. This has haunted my every step ever since. it has prevented me from getting good jobs and even getting college loans. I am not a criminal. I did this with two other people out of desperation and stupidity. I need to know if there is any way to clear this from my record to be able to pursue a meaningful life. Any help would be greatly appreciated.

Not quite, but you would be able to possibly turn it into a misdemeanor, which would be a lot better than a felony... once they fulfill all of the obligations such as pay any fines, complete probation, and anything else required, they can then go to the court, and fill out the paperwork to have the charge be "expunged" which means that it is turned from a plea of guilty into a plea of no contest, and if it is approved, then it will change to a misdemeanor... In Michigan: Can my ex-husband have domestic violence removed from his criminal record?

He has two domestic violence charges (found guilty both times), one he got probation and after six months they cleared it off his record. The second "recorded" incedent is still on his record. There are pictures of the damage done to me both recorded incedents. Now he wants to have it removed from his record, stating that he can't get a job to pay child support because of it. I need to know if it is possible for him to have it removed and how I could prevent it. I am fearful that someother woman will fall for his lies and end up dead. Please help. I feel like I am the one being punished.

In Florida they cannot get this removed by expunging, he would have to hire an attorney and pay huge amounts of money to attempt this. I would also contact your local victims group through the courts or law enforcement and explain your fears to them. Also on another note, there are support groups online as well as offline to help victims of dv get through things like this. It is called empowering yourself. This is the hardest thing one can ever do (I know because I go through it daily). Just because he is not physically abusive to you any longer does not mean he is still not committing dv. DV encmpasses much more than battering or physical abuse. He is financially and mentally abusing you right now with these bully tactics. This is similar to a batterer telling the victim to drop charges because he will go to jail. He is trying to make you believe that he cannot do anything with this noose around his neck.

Well he put that noose there. He chose to batter and abuse. Get CSE to help you in regards to your cs. Empower yourself too!!!! Take baby steps and you will feel less and less victimized.
