Why are the men & women who hold free energy invention patents imprisoned?

Is there a logical reason for this attitude toward fuel efficiency in this country? Do the oil companies feel threatened? Is this a control issue?

How do folks with registered patents make money if their invention is used?

Say you got a great idea see? and you go through a rigorous patenting process with some lawyers to protect your idea. It turns out that you are granted an original patent. After the expenses are covered when can you see some dough?

Bill M was right about getting value from your patent but it is also important to know that if someone practices your invention without licensing or buying your invention then you have to sue them to get your anything from invention. Just having the patent will not result in any money being sent to you. You have to pursue infringers through the courts.

I have come up with (what I feel is) a wonderful invention. How can I protect the idea without costly patents

It is a simple solution for some drivers. I do not have the financial resources to go to the patenting office. I would like to protect my product. Any ideas?

I daresay you may not need a patent.

What you need to do is be first to market. A patent can not protect you from a copycat competitor doing the EXACT SAME THING but moving a screw three inches to the left.

The solution, again, is be first. Being first will skim the profit cream off the top and establish your name as the forerunner.

We faced this same issue at MadMimi.com, where we're offering pretty much the only WYSIWYG email marketing UI – something really simple and different. There were naysayers at Mad Mimi who were concerned that we'd be copied right out of the gates by bigger players like Constant Contact. (OK, I was the naysayer.) But the fact is, who cares. Be first. Be best. Don't ever look back. We're huge now. You will be, too.

If you can't fund your invention and want to sell it to a big company for royalties, they'll do the same thing with your product and you'll be fine, although they'll probably spring for a patent for the heck of it and so they can say "special patented process" in the ad. All you need if you go that route, is a non-disclosure or non-compete contract, which any lawyer can draw up for $150 bucks. Less if the lawyer's related to you. :) Good luck.

Is an innovation a change over something that's been invented?

Innovation has nothing to do with marketing directly. Nor does it have anything to do with an invention directly.

You can innovate in any field or anything withhout an invention in sight (see Starbucks below). Simply put, when you innovate, you introduce an improvement in something. The innovation can be tiny or huge. It can be simple or complex.

Starbucks has brougth decent coffee to masses of people. That's a simple innovation but on a large scale.

Apple introduced the iPod which is a portable digital media player ... plays MP3 audio files. MP3 is an open standard audio file format. So Apple did not "invent" anything but they innovate by packaging existing technology in a way that allowed people to enjoy their MP3s on the move.

That is complex innovation compared to Starbucks.

Many people say technologically the iPod is far inferior to other devices that do the same thing ... but you can see that their innovation (ie marketing a portable device before anyone else) has given them the #1 place in the market.

Now, inventions are when you find a totally new way doing somethig that has bever been done before. Or when you create a new tool or technology that does something better than it is currently being done with current tools or technologies.

Flat screens (LCDs and Plasmas) for example are replacing the old tube technology for TVs and computer monitors. These falt screens do somethng that was being done already so they did not provide a new method/way but they did provide new technology for electronic information display.

By the way you cannot get a patent for anything new just because it is new. It must provide some sort of benefit. ANd falt screens of course do (lighter, thinner, cheaoer to manufacture, take less energy, have much less radiation, etc).

Genrally you can get a patent for an invention but not for an innovation. In fact there is no such thing as an "Innovation" patent. You can only get a patent for an "invention". You can get a patent either for a new method/way or a new tool/technology.

So Apple or Starbucks could not get a patent for their innovative products (though Apple might have some patents for something inside their device but not for the iPod as a whole).

Meet Austin Meggit. Like many other 12 year old boys, Austin is involved in lots of activities outside of school, like Boy Scouts, the school newspaper, soccer, and baseball.

When Austin was 9 years old, he wished there was a way to make it easier to carry his baseball equipment on his bike when he rode it to practice. He saw other kids riding their bikes to practice, and they had the same problems he had with carrying his equipment. He then decided that he should invent a bat and glove carrier for his bike. I have a beautiful little idea for an invention but I don't know what to do now. It's a simple little thing like two four inch screw-like things made of metal and coated in rubber. How do I get this patented? Where then do I go to get a few made to sell?

You need to patent it first. Go to your local city office building and ask for a patent form (some have it, some don't). You can also get forms online, just google US Patent.
