Lying Opposing Attorney! Work Comp?

New postby Mark » 28 Nov 2009, 16:08

Hearing officier sides with opposing attorney with her accusing me saying something when I never did!

and I spoke up saying I never said that! yet hearing officer puts it in his decision just what opposing attorney said in her favor!

hindering my case! and hearing officer says I am not creditable
due to this opposing attorney lies/it doesnt even match up to the
print out nor the court recordings but noone will even look!

well if she is lying to do so!

then that means I can lie in court to protect myself?

I had an obundsman and they dont work like an attorney for you

why must I be truthful but opposing attorney doesn't have to be?
I am NOT LYING !
I said "I MAY hit my already broken knee on the inside of my van "
black and white.printed off from allstate!
mind you I had already shown the judge that I was wearing an unbenable immobiliziler!
I got proof from a doctors statement!
and I showed him that too!
at the
time when someone had rear ended me at
ONLY five miles an hour!
but the opposing attorney YELLED out in court YOUR SMASHED your knee on the
dash board didn't YOU!?
we all heard YOU on tape WE GOT IT
and I NEVER SAID THAT
I HAVE IT RIGHT HERE BLACK AND WHITE
i said i may have bumped it
reallizing that i have an immobilizer on I couldn't of hit it! I had that on!
But the hearing officier who NOT even a judge
put it all in the opposing attorneys favor!
and said I was uncreditable!
how horrible!
since I have no money and they do!
I loose!
It is allllll stupid cuz cuz ya dont get knee injuries by head on ! and at five miles an hour!
so does this mean that I can do artistic word play?
state of texas where else could this be? and does texas have a personal problem with yankees? by chance?
"I SAID I MAY HAVE HIT MY ALREADY BROKEN KNEE ON THE SIDE OF VAN"

mind you the side of van is NOT my dashboard!
yet the opposing atty yells out YOU said you struck you knee and smashed it on the dashboard!

wow I call the lying!

later I spoke to an atty he said if he was with me that would never have happened!

I am appealing this and I will YELL OUT

OBJECTION!

and if they tell me to shut up I will hang up! LOL

You were accused of saying something. You denied it. The finder of fact didn't believe you.

Part of the hearing process is the assessment of credibility, figuring out who to believe, and the adjudicator will be afforded a great deal of latitude in this area.

That said, if there's absolutely *no* evidence (bearing in mind that a lawyer's submissions aren't evidence) of you saying what you were accused of saying, you *may* be able to have the decision revisited at a higher level. (Exactly where you go depends on what jurisdiction you're in, and what tribunal you were before. And that can affect the test for review, as well.)

That is a tough case for a workmans comp claim. If you are serious you could file in a small claims court. I bet you don't have enogh evidence to back your claim up though. What you really should do is get over the old job and get a new one that you might like. However, you probably will never be happy with any job.
