I sold a truck o n eBay and now the buyer is claiming I misrepresented the truck and is going to an attorney.?

Does he have a case? Here is the ad, "Nice truck that has been well maintained mechanically. It does need a new speedo cable and new emergency brake. The interior has no major defects. There is a dent on the passenger rear side where the bumper attaches and the paint is a bit worn on the drivers side and top of vehicle. More pictures provided upon request. Seller reserves the right to end the auction at anytime. All sales final, NO RETURNS. Winning bidder must pay a non-refundable $500 deposit via PayPal within 24 hours of auction close. The remainder balance must be paid within 48 hours. Buyer responsible for pickup or shipping details/costs." He is now saying that the truck was not what he expected and wants $500 back. He came from out of state to pick it up and test drove the truck and left back to his home.

Don't worry about it. He bought the truck and now it belongs to him. You can't take the truck back because you have no idea what he has done with it since.

Some states do have anti-lemon laws, but that only applies to rolling back the odometer, painting the tires, etc.

Just think about how many used car dealers go through this every day, and they never, ever, will take the car back.

Does having an LLC protect the trucking company even if the owner is the only driver? Wouldn't someone just go after the driver personally, which would be a round-a-bout way of getting to the company, being that the sole owner of the company is the sole driver?

LLC is actually the other way around. It protects the owner from any downfall of the company. The owner should have their own personal "pay" from the company that can't be touched incase the company has an issue with a law suit or bankruptcy.

You would have less damage with the bar in tact.


There are numerous studdies, mostly from england, showing that the extra bar prevents smaller cars from running under the truck and decapitating the occupants.

Can an attorney put a lien on a truck owned by new husband and myself from x husbands debt 5 years old?

This is for a Vet bill for 1500.00, now it is 2800.00 from interest.
xhusband filled bankruptcy, now attorney is coming after me

If your ex filed bankruptcy and you signed paperwork at the vets, you would be liable for the bill. I know, it bites, I am in the same situation with my ex and the house that he has I haven't lived in for over 11 years.

If the attorney has a judgment from the Court, he could attach to your property or garnish your wages, but don't see how he could attach to joint property, and certainly not your new husband's property owned soley by him.

If the attorney does not have a judgment and with the debt being so old, I would ask for the attorney to submit proof that you signed the papers at the vets office...if they can't produce them it may be harder for them to get a judgment and you might be able to work out a settlement agreement to pay a percentage of the debt in a lump sum to make it go away.

Know this is not what you are going to want to hear, but it would be best to talk to a lawyer as laws vary by the state you live in.
