I had them for two years they were horrible, ripped me off. i had so many problems with that company!!!!!!!!! i have NJ CURE now and there great never any problems. I'm sorry you have them get rid of them as soon as possibly.

Can you file a personal injury claim with 2 insurance companies?

I was injured a rear-end collision. The at-fault driver was driving an insured vehicle that belongs to his friend. The driver also has insurance. Can I file a claim with the insurance covering the vehicle as well as with the insurance of the at-fault driver?

Yes. You should file against ALL potentially liable entities, including your own. They will figure out who should pay what to whom. All claims may not be honored, such as the one to your own company, but they will help settle it because they do NOT want to have to pay anything. Make sure you let each them know all of the filings made.

If you are looking for monetary reimbursement for injuries, you may mention a sum and the potential to speak with an attorney, a counter offer will most likely be made, if not an outright payment.

You may get an attorney if you like, but expect at least 33% of any payment to go to them. This is sort of a waste unless you are hurt badly.

Not sure exactly what you're asking . . .if you have a PERSONAL INJURY claim, that's defamation of character, discrimination, or other NON BODILY INJURY.

The JUDGE files the judgement. Another party can file an appeal, a suit against you, or a lein against the judgement.

Typically, in a BODILY INJURY suit, if YOU win a judgement against someone, YOUR insurance company (like, health insurance) will file a LEIN against that judgement, so they get their money back first (for what your medical bills cost THEM.)

What are the steps in settling an insurance property/personal injury claim?

We are the "Victims" of our neighbor's truck crashing into our house. Out property damage is approximately 20,000. Personal injury- medical, lost wages, etc. is approximately 10,000.00

Give his insurance companies adjuster a fair chance to settle with you.
If you feel their offer is unfair, call an attorney who works with insurance companies.

Can a judge grant a personal injury claim more amount than what is covered by my auto insurance ?

I met with an accident in the parking lot of a shopping center when the car i was parking accidently hit the showroom window. an employee has filed a personal injury suit against me. i have insurance coverage of 15k. can the judge grant a higher amount and if so what will happen if i cant afford it?

Your insurance coverage limits do not dictate what a judge will do. Yes, he CAN grant a higher amount than $15k if he feels that the damages exceed that amount.

If you can't afford anything then don't worry about it. They can sue you, but if you don't have any assets there's nothing they can do to collect.

In some severe cases, they CAN withhold money from your salaries but that is totally dependent on the case and the judge.

Can i claim personal injury through car insurance if suffering mental trauma through fraudulent allegations?

This time last yr I was accused of crashing into someones car. What actually happened was the driver rolled into my car. He is trying to make a claim against me and it has caused me a great deal of stress. To the extent to which I have almost lost my girlfriend through worrying about it. as it made me rather angry at being ripped off so badly!. my car insurance would increase by over £1000 a year!

If this goes to court and is ruled in my favour. then the way I see it is he has broken the law in making a fraudulent claim. I have pictures of both vehicles showing no damage. And he is actually claiming for his daughter. i didnt see anyone else in the car and my insurance are in the process of gaining access to check the school records for that day.

My question is. if it is proved he is lieing. can i put in a claim through my car insurance company to be compensated for the stress caused?

I'm a big believer in Karma. that's why I thought about makin a claim. cos right now Karma owes me! It's been really stressful! I have been in a car crash were everyone in the car claimed apart from me because I genuinley wasn't that injured and didnt feel it necesary to claim. where as this has really caused mental anguish!

Weirder things have happened. But if you try to do it without a lawyer, you'll be laughed out of court.

Have you got a competent lawyer representing you in the suit against you? If the photos clearly show no damage, they should be able to stop the suit in its tracks.

You wouldn't be able to sue them under your car insurance. That covers only your liability to other people, not their liability to you. The insurance has nothing to do with that.

It would be a matter of a personal lawsuit having nothing to do with cars, but after the fact... a lawyer would be able to advise you how to go about it, if at all possible. It would likely involve something like going and getting a psych evaluation, going to the trauma ward, or going to court on your current case wearing a neck brace.

That is the big wild card in accident cases, of course. Back and spinal injuries. Because it's medially recognized that you can suffer trauma even though they can't detect it through tests, it is very difficult to disprove that you have an injury. If you prove it was the other guy's fault, then you've got them on the hook for an injury. It's an old trick but it's risky too, if they ever prove you made it up. This forum thread would be evidence of that so you probably shouldn't try the fake back injury trick.

Your lawyer might hate me for even mentioning it.

Since you believe in Karma, you might be interested to hear that Karma never affects you during the same lifetime. It's not the same as "what goes around, comes around" or "tit for tat." It's whatever you did in a past life coming back to you in this one, and often in completely different form.

( Edit: Just read your other questions, so here is some more info. I am guessing that they will allege that their client (the owner of the elevator) is not responsible because it was purely an accident or that they were not negligent.

Usually you must prove that some negligent action or inaction led to the accident. Otherwise the elevator would be the guilty party, and you can't sue an elevator.

The only problem here is that your case would have to be that they failed to properly maintain or repair the elevator, and that would be hard to prove. If you or, even better, others had complained about faults and they didnt bother fixing it then that would be a good case. )

No. This is where the game begins.

Ask them for specific reasons and copies of all documents related to your case immediately.

Do not say or write anything that might be used against you. Do not agree to see any more of their doctors unless you are absolutely req uired to by your policy or law.

If it is a private contract of insurance with a company, then you need a copy of the contract, and specifically, the provisions that relate to your type of injury claim (some have different rules for some injuries or sicknesses).

If you still disagree after looking at it, consider contacting a lawyer or appeal yourself if you feel comfortable doing so.

A lawyer is a good plan, but do some leg work yourself to make it cheaper. Then you can have the documents ready for the lawyer on your first visit.
