How does one request a paternity test in Maine?

My husband has a 5 year old "son" who hasn't really been part of his life. There's been some question as to whether he was really his. I know he loves him, but considering his mother makes a lot more money than us, he pays for his other son and we had a new baby, he'd like a paternity test. (Also the "dad" has now found out about him and is trying to get involved) Do we contact the state or a lawyer? Who is responsible for the cost? Any advice would be great, thanks!
We live out of state. He's been paying the court ordered support (for 2 kids). Also, assuming the child isn't his, could he be reimbursed for the last five years?

I am in Maine also... you can call your local Department of Human Services office and they will help direct you. Has your husband been paying mandated child support or just paying out of pocket? (bad idea by the way, as the state does NOT recognize 'out of pocket' payments to the other parent or child)

I received in the mail a request by the state stateing that it is required for me and my child get a paternity test to prove who the absent father of 2 1/2 years is. Can I deny this request?

If you deny the request (if it is court ordered or ordered by an agency in the state) you could face serious problems. They might be able to deny services and monies. The court could find you in contempt and jail you or impose fines until you comply with the court.

If it is just a request by a possible father; he has the right to challenge you in court and ask for equitable relief.

We currently have temporary custody of my husbands nephew. There is another hearing coming up to make the order permanent, however the judge wants to find the father first. I have located him, but am unsure of what steps will be taken next. Can the court legally force him to take a partenity test or is it assumed that he is the father because the mother named him and the burden of proof lays with him? Also, what type of notification is sent to him regarding the case?

Get a DNA test on the father. That way, if he chooses to give up his rights it will be based on fact. If he is not the father, then you could get blindsided by another man that could take the child from you down the road. It is best to resolve the matter now.

Well what a silly doctor. I am not 100% sure. (i had one when i was 16) It is just a mouth swap, you, the baby, and the father. I think my father instigated it. maybe call another doctors surgury. I am pretty sure that both you and the father will have to split the costs 50/50. But if either of you are on a low income you can get it covered by medicare, so worth looking into. call a helpline and ask. or maybe call the local hospital. goodluck sorry im not much help!

EDIT: SCAT you reminded me of something! For my paternity test my Father wanted it done (so it was elective on his part) that is why my mum got it free (she is low income) I remember her saying if SHE was the one to instigate it she would have to pay her half herself. so yeah... SCATs right!

In a time before paternity tests,how could men be sure their children were actually theirs ?

I was thinking maybe they could say some all powerful being said that sex was only allowed within a relationship established through public ritual, but of course nobody would believe that. So, how would you make sure it was your biological children who inherited from you?

I was getting married to this girl from Ohio and things didn't work out, but now I found out she is pregnant and saying it is this other guys. We did not end on a good note and I think she is telling this guy it is his, just to keep me out of her life. The reason I wonder if it is mine, is because we had a boo boo, she missed her period, and then she had this talk with me right before we went our own ways. She asked me what if I were to get pregnant and things didn't work out? I told her that unlike my father I would like to be a part of my childs life and she told me that she is afraid that I would want custody and she would never allow that. I din't think twice about it until someone told me she was pregnant and that is when I asked her. First she wouldn't say, but now it is no. I asked for some kind of medical proof that this guy she was dating for not even a month is the father ( we were little over two years). She told me that she wouldn't give me any medical record proof.Plz help

I wish there were more men out there like you at least you are trying to take responsibility for a child who may be yours but you dont want to take the risk of the child being yours and you not doing anything. I do commend you on that.

If the mother is not willing to have this done it may need to be court ordered. To find out more about having this test required by the court please consult with a local attorney who specializes in custody, paternity, and child support cases. Do they actually ask you in the hospital if you wanna take the test, Or do they just do it or do they need my permission too. Or can he just say he wants the test when we are in the delivery room Please let me know .

No they do not normally ask you, but you may request one. Let your boyfriend ask for one , they will charge him for it. Don't deny him the test it just proves he's the father and you two can go on, No doubts on there part. Saves you a big headache latter should they want to bring it up! Ps congratulations . Don't stress out this is suppose to be a beautiful thing don't let him ruin it for you.
