What is the statute of limitations for suing a psychoanalyst for professional malpractice?

Is there a time limit when it comes to suing therapists for breaking confidentiality, libel, slander?

6 years in most instances. After that time, no one saves records and witnesses' memories fade..

Who sells affordable professional liability / malpractice insurance for dentists?

Looking for more affordable insurance for me, my partners and our dental practice. We think there is too little choice of insurance companies offering professional liability and other commercial insurance to dental practices and dentists. Does anyone know who else can offer us more choices in competitive coverage?

Well, professional liability isn't much of a moneymaker, from the insurance company's point of view. Luckily for you, dental malpractice is a lot less hazardous, however, unluckily for you, most insurance companies won't offer just ONE class of malpractice insurance.

That means, in any given state, there is very, very little competition for professional liability coverage. You don't say where you are, but there are probably less than five carriers in your state. Several of those would probably be non-admitted carriers.

The best thing to do is see if you can hook into a state wide professional group, and have the group negotiate a 5% cut in rate based on volume discount.

Define cheap.

There isn't much competition out there for medical malpractice, the rates are all pretty much the same. The biggest difference is in the tail or retroactive date - so if one policy is drastically lower than another, you can be pretty darned sure that you're giving up coverage somewhere.

You need to talk to the doc that supervises you, and go to HIS agent to get a quote for your own.

One is a subset of the other.

Professional liability is the umbrella of coverages that includes more than just malpractice coverage.

Malpractice insurance comes into play when the provider has a standard or duty of care. In medical cases, the doctor has standards of care that may be abridged. In legal cases, the lawyer has a duty to provide a certain level of competence.

Yes it affects the way myself as well as my colleagues practice. There have been numerous of times when I do an expensive test even though I know the result will be negative, just in the 1% chance that it comes back positive. I think the best case is falling and hitting your head...do I need to get a CT scan of the head.

Most trauma to the head do not require head CT. However, say I DON'T get a head CT, and it turns out to be a bleed in the brain...then I'm liable. Let's say I get a head CT and it's negative, and sent the patient home, but he has a delayed bleed later on. Then even if I'm sued, I can say "I did the best test I could...a head CT...and it was negative".

Meanwhile these "unnecessary" costs are adding up making it more expensive for Americans to have insurance or medical care.

I say first get tort reform, and less physicians will be practicing "scared medicine"

Malpractice varies depending on what your profession is, what state your in, and your claims history. A dentist in CO is around 12,000 , where as an Oral Surgeon is around $12,000. An anesthesiologist is around $16,000, OBGYN $$35,000... See how it differs?

These rates vary per carrier too...

They would have to BREACH the standard of care AND cause harm as a result of that breach.

EX:Patient needs right leg amputated. Surgeon removes the left leg = malpractice.

Except for a politician none of the others can irrevocably change your way of life and even a politician can be changed. A doctor could concievably work without malpractice insurance but one good suit could wipe him out.
