Help, Forclosure?

Hi,
I would like to know if a morgage company can forclose on a home if the payment is not even 30 days days past due, just about 20 because of a screw up with a bank draft. this company is Green Tree out of MN.

If this is a first mortgage, then no they can't. They can send you letters or let you know that you're in jeopardy of being in default, but they can't foreclose. They have to notify you that your loan is in default; after ninety days, they will send you a notice of Trustees Sale, which means that they're selling your property to recover the loss if you don't bring your loan current.

Your only issues now are that you'll pay a late fee, have a ding on your credit and get nasty letters and phone calls.

I paid a company 2000 dollars, they said that they were goingt o talk to my bank and make arragements so i wont have to pay my mortgage and what i didnt pay would go back into the loan with intrest. well i did that ans they never did it i called them back but they do not answer at all do not know where they are located!

I don't know, try the attorney general in your state for advice. That's what I did. But now, because the company is located in another state, so I would have to appear in court to even see if that state will press charges. If you find out something differen, PLEASE let me know! My house went up for auction. i want to now who would lend us the mney to get our hase back in six months

Sorry about your situation but I do not think that anyone will lend you money if your home is being foreclosed.

Mortgage Co. has initiated forclosure proceedings. Help. What can I do to keep my home?

I am behind on my payments. I could get caught up with payments within two months -if they would allow me to do that. Are they likely to be helpful? Are there any laws to help people keep their primary residence?
I began having financial difficulty when I lost my job last January. Since that time I have started my own business and business is booming right now so I could get caught up on payments and late fees quickly, if they will allow it. Any info on the subject is very welcome.

If you are only two months behind and can send them the payments with the late fees via certified, then do it. If I am not mistaken they cannot refuse your payments and they must stop forclosure if you are current with your mortgage payments.

If they do refuse your payments, you would need to contact an attorney and have this rectified.

Usually they will first send you a letter stating that forclosure proceeding has started but only if they don't receive the amount for $$$ immediately.

You aren't technically in forclosure until the mortgage company files in court and you will be notified by the court of the forclosure filing.

Just send the payments ASAP if you can.

Is anyone actually doing short sale on preforclosers to help people out of forclosure ?

When an owner of a property is in default they will soon be in forclosure. The bank records a deficiency at the county recorders office. The idea is that there is no equity left in the property due to large first mortgage and large second and maybe a third. Well at the forclosure the 2nd and 3rd will be wiped out. I would represent the owner and with proper documents talk to the 2nd and maybe 3rd mortgage holder, being the lender to discount their 2nd thus equity becomes available.

Going into forclosure, please advise is can an attorney help to get us a new mortgage to save our home in Mi?

We have been trying to get a modification with Countrywide, but have no faith in them. We have been in our home 24 years. Never missed a payment or been late. Got an Arm that has already adjusted once. Low income from Social Security Disability. The second adjustment will be in January at that time we are absolutely done, can not make house payment.
WE ARE NOT BEHIND ON OUR PAYMENTS. NEVER LATE.

You don't need an attorney to get a new mortgage, you need a banker or a lender.

Your low income is certainly going to be a factor, but so is your payment history and, presumably, the amount of equity you have in the place.

If I let a mortgage go into forclosure will the tax debt relief act signed in 2007 help me?

This was my principle residents for three years. The original loan was for 84,000. I refinanced and it came up to 94,000. I refinanced again and it came up to 102,000. I know probably it might cover only the original loan of 84,000. Will the relief act not the bailout help me? How much phantom tax would I have to pay on the remaining 18,000? Thanks for your answers!

The best thing to do is AVOID foreclosure. If you are having trouble affording your mortgage, there are a few options you should try:
1. Short Sale
2. Loan Modification
Since the Debt Relief Act passed in 2007 any homeowner that sells their primary residence via short sale is not responsible for tax implications or loss incured by the lender.
A loan modification may help make the loan affordable, but you will usually have to pay a fee for this service. Try www.NationalShortSaleOffice.com. They are one of the less expensive companies out there and are reputable.
