Product Liability Suit

Product Liability Suit? Seat Belt?

New postby Tonisha » 28 Oct 2012, 13:52

I am wondering if there is something that can be done. I have researched the internet an it seems that I was able to find similar cases but nothing close enough.

Just to put in short for the moment I was in a accident due to road conditions. (Black Ice) I had rolled my car a few times in the air with my seat belt engaged. Then all of a sudden I woke up outside the car 25ft from where it stopped I was thrown out the passenger window. My seat belt was on an I have cuts and bruises from the seat belt. It had broke while in the roll of the car.

God was on my side the car, an the area I shouldn't of been as lucky as I am !

I hope someone could help me out I feel that if a safety device fails why is it a safety device in the first place an it could of been someone else or myself an died
I forgot to add the car was not rolled over on top it missed the top, the seat belt was caused to fail by the force of the turn. It should still hold its own, If it wasn't for the fact I had been thrown into the open road I would of been killed by something else. to what they said I would of had less injury as the inside of the driver area was fine, the door was hit but was not in my way from sitting still, the belt snapped causing me to be thrown out. So accident didnt cause the belt the belt should of held alot longer then the accident, (witness said less then 30 sec)
Ok, I am sorry about blabber I had put up! I appreciate all the great answers. I have contacted a Lawyer and its actually a case under the "Product Liability Act of OHIO" I have a case because the fact of the nature is, Careless if I HAD NO CONTROL the seat belt should of stayed in tact through the whole accident.

Again thanks everyone! This happen DEC 15th 2009 at 9pm So I am still a bit out of it,

I drove a Honda 2000 series

Wow haha, I found it alittle difficult to read; improve your sentence structure because I barely understood what you were saying.

If the seatbelt fails, you got a case. Period. Seatbelts are desined to restrain occupants in SEVERE accidents. The fact that it snapped in the force of the turn (before the accident even started) and not from the flipping, you really have a case. The seatbelt should have held you down throughout the entire wreck. You need a lawyer, and you need to sue the automaker (as long as you hadn't modified the car's structure or seatbelt where it could have produced undesired performance). What kind of car was it may I ask? I know Ford had a recall on their seatbelts. GM; I don't trust their seatbelts either. I wouldn't buy american again if it was an american car.

PS. God was on your side, you have a purpose in life (otherwise why would have he spared you?); be blessed.
